1. Agreement & Overview

These Terms of Service (“Terms”, “Agreement”) constitute a legally binding agreement between Parikshafy Technologies Private Limited (“Parikshafy”, “we”, “us”, or “our”) and the legal entity or individual subscribing to or accessing our online assessment and technical screening platform (“Customer”, “you”).

By registering an account, provisioning an organisation workspace, or accessing our services, you confirm that you have the authority to bind your organization to these Terms.

2. Description of Service

Parikshafy provides a multi-tenant, cloud-based platform for authoring technical assessments, inviting candidates, executing and sandboxing code, conducting proctoring checks, and evaluating candidate performance.

We grant you a non-exclusive, non-transferable, revocable license to access and use the platform strictly for your internal hiring, technical evaluation, and certification operations in accordance with your chosen subscription plan.

3. Customer Responsibilities & Candidate Data

Authority & Candidate Consent: You are solely responsible for ensuring you have legitimate lawful grounds to invite candidates, process their personal information, and conduct any proctoring or automated evaluations.
Evaluation Decisions: Any hiring, rejecting, or qualification decision is made solely by you. Our AI summaries, code analysis metrics, and integrity scores serve exclusively as decision-support indicators and not automated employment decisions.
Account Credentials: You must safeguard all administrator and recruiter credentials and notify us immediately of any unauthorized account activity.

4. Subscriptions, Candidate Credits & Payments

Plans & Quotas: Services are billed on a subscription basis (monthly or annual) and/or candidate credit quotas as detailed on our Pricing page or in an enterprise order form.
Taxes: All fees are exclusive of applicable taxes (such as Goods and Services Tax / GST) unless explicitly stated otherwise.
Candidate Credits: Candidate credits are atomically consumed when a candidate initiates an assessment attempt. Unused credits expire at the end of the billing period unless your plan includes credit rollover.
Verification: Subscriptions and credit top-ups are activated only upon verified payment confirmation from our payment gateway providers.

5. Acceptable Use & Proctoring Integrity

You agree not to:

Reverse engineer, decompile, or attempt to extract source code from the assessment runner or sandbox environments.
Deploy malicious scripts, exploits, or unauthorized automated tools through the coding IDE.
Use the proctoring features to conduct unlawful surveillance or capture data outside the assessment scope.
Circumvent plan limits, rate limits, or tenant isolation boundaries.

6. Intellectual Property & Data Ownership

Your Data: You retain all ownership and intellectual property rights in the custom questions, assessment configurations, and candidate results created within your workspace.

Platform IP: Parikshafy, its logos, assessment engine, question banks, sandboxes, and documentation remain the exclusive property of Parikshafy Technologies Private Limited.

7. Limitation of Liability & Warranty Disclaimer

The service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express or implied. To the maximum extent permitted by law, in no event shall Parikshafy Technologies Private Limited be liable for any indirect, incidental, special, or consequential damages, or loss of profits or data.
